Travel Contracts are governed by specific international agreements, particularly by the Brussels Convention of 23 April 1970 relative to Travel Contracts (CCV), made enforceable by Italian Law no. 1084 of 27 December 1977, by D.Leg.no.79 of 23 May 2011, ”Tourism Code”, by the situations provided for in the Italian Civil Code, by Italian Regional Law (L.R.) no.7 of 31/03/2003 and by other rules of internal law. Responsibility towards Clients shall not exceed the limits provided for by the aforementioned Laws and Conventions.
Moreover, the following quoted general sales conditions are applicable.

Since contracts having an object consisting solely of transportation, accommodation, or any other separate tourist service, do not fall into the category of Tourist Package, such contracts are governed by the regulations laid down in the CCV( art. no.1, no.3 and n.6; arts. .from 17 to 23; arts. from 24 to 31) as far as situations different from those relative to the organization contract are concerned and by other agreements specifically referring to the sale of the single service that is object of the contract. Moreover, the following quoted general sales conditions are applicable.

Are accepted subject to availability.

Reservations are valid only if the confirmation is followed by immediate payment of a deposit equal to 25% of the total cost. Balance payment must be made at least 30 days prior to arrival date.

In the case that services must be cancelled, attributable to the client’s will, no reimbursement will be made, unless the client agrees to present a clear and specific declaration giving valid reasons to the hotel, for why the client cannot honour the reservations made. If the declaration is accepted by the hotel then agency will reimburse the amount authorized by the hotels less the agency fees.

In the case of cancellation of the services, Beverly Travel will apply the following penalities and agency fees:

- 25% of the total cost up to 26 days arrival;
- 50% of the total cost after 25 days and up to 15 days before arrival;
- 75% of the total cost after 15 days and up to 7 days before arrival;

For cancellations less than 7 days before arrival , no refund will be made.
Even for no-shows of one or more persons as compared to the latest rooming list forwarded.
Usually, cancellations of confirmed groups are subject to the above mentioned penalties.
However, in case of Exhibitions, Holidays and Special Events ,cancellations, even of a single service, could be subject to higher penalties.

 

Booking may be cancelled by the client, without incurring penalty charges, if beverly Travel has to change one of the essential services of the booking, or if there will be an increase in the cost higher than 10% of the total price. If such a case should arise , the client must communicate in writing, their intention to cancel the booking or the acceptance of the modifications, within two working days (art no. 90 no.,91, no.92 “Consumer Code”)

During the tour , if some essential part of the services booked cannot be maintained , the oraganiser will provide suitable alternatives without charge to the client, or will reimburse the difference between the services originally booked and those received (art. no.,91 “Consumer Code”)

Beverly Travel shall have the right to substitute hotels and/or tourist resorts with others having similar characteristics, for operational reasons or as a result of circumstances arising, in observance of the applicable laws in force.

Any omission , in the implementation of the contract, must be contested by the client without delay, so that Beverly Travel or its local representative, can promptly find a salution. The Client can moreover send claims by registered mail, with signed delivery, within 10 working days and not more , from the date of return from the point of departure.

Rates include VAT. and service percentage , (V.A.T and taxes valid at the moment of the brochure-printing. In case of tax increase published rates are subject to adjustment). Carafes of tap water, mineral water, drinks , extras in general, tips, tansfers, optional excursions. City Tax and insurance are not included.

To guarantee the scrupulous fulfilment of the obligations assumed vis-à-vis the Client, Beverly Travel has stipulated an insurance policy with  AmiTour Insurance n. 1505001051/V in fulfilment of the terms laid down in arts. 94, 95 and 99 of D.leg. N° 206 of 6/9/2005 “Consumer Code”. Under the terms of art. 100, it is also declared that a national guarantee fund has been set up at the Ministry of Productive Activities to allow the Organizer, in the event of insolvency or bankruptcy, to ensure the reimbursement and repatriation of the Client in the case of travel abroad. The methods of intervention of the fund are established through a Decree of the Minister of Productive Activities, together with the Minister of Economy and Finance.

All baggage is at the risk of the participants and this agency cannot, under any circumstances, be held responsible for eventual loss or damage.

For any dispute or controversy, the Forum of Rome Italy will be the deciding body.

All personal data will be processed according to the provisions laid down in D.Leg.196/2003 and used exclusively for the fulfilling of the formalities required to make the booking.
Clients have the right to change, add to and request cancellation of the personnel data supplied by them.
